omg..sellling my first photo of Chateau Frontenac to Quebec city administration.

Yes i am excited but just dont know what to do.

They want to know how much i ask for the full exclusive rigth for all media type and all country.

I just dont have any idea how much i can sell this. My first thougth was 500$ but i really dont know. Is it enough, is it too much. Any comments apreciated.

My initial reaction is, not enough. With rights in all media and all countries, you don't have any rights any more.

It sounds to me as though you are trying to skin the cat before you have even killed it. Few thoughts to bare in mind.

1. This is your first image to sell (congrats i mean it) however dont go and over charge all they will do is turn you down or worse not come back to you after the sale.

2.Its a nice image but not impossible to go out and get another similar version if you like it so much and cant live without it. give them the full rights and go get a similar one to which you have the full rights to still. Everyone is happy.

3. If this is your first sale with them try thinking more in the lines of selling them more than one image over a period of time, in the long run thats worth a lot more than one single sum whatever the value. Get in there good books and who knows where that might lead to.

Just food for thought. Keep up the good work. You have nice strong images

if your selling them full rights for something like that $500 is not enough. one person about 6 years ago sold one image for the exclusive rights to - and he had to erase the picture because it wasn't his any more), was like $5000.

at the very least you'll need a contract and what kind of rights they want. (this is a gray area for me as i can't stand working outside of a POD place. if they are using it for say a years time, then it would be a lower price. the idea behind selling exclusive rights is: how much money would i be able to make if i sold this as a POD, or to other people over say the next 10 years. if it's more than $500 your not charging enough. if the image is non-exclusive it's a bit lower. ---Mike Savad

also if they have a contract, READ IT VERY CAREFULLY.

one contract i read that someone else got, said that we get exclusive rights for this image, and anything like it. so anything with the same theme, technique, etc, they some how now own. then there are indemnification areas, that hold you responsible for the image that you may never had the rights to sell - that would be tossed back to you.

for example - that building (i assume is the one your selling), do you have a property release from them to even sell it? because they can sue you. my agent wanted me to release images for a cafe project - but i didn't have releases for those things and i don't even know where to start to get such a thing. would it be from the building owner, the cafe owner? didn't know, didn't want to take a chance, lost the sale, but kept my future money.

often people will take advantage of photographers. and some buildings may not be allowed to be photographed let alone sold(there have been cases like that too). so do some homework. ---Mike Savad

The Chateau Frontenac is the world's most photographed hotel, it is a National Historic Site of Canada and part of a UNESCO World Heritage Site. I would say based on the number of photos one can purchase of the Chateau Frontenac that the building not copyright or trademark protected. This should also give you some idea of the going price for a photo of the hotel.

but then again i heard you can't sell pictures of the new york stock exchange. don't know if that's true, but i'm not testing it out. just because it's photographed, doesn't mean he could sell a photo of it. they may have licensed their own image and he could be sued if someone tried selling it. doesn't matter how famous it is. there was a case about a red bus in england, just so happened that a tourist store owned an image that was their logo of that spot with that bus. they won the case, even though it's a common site, and well photographed, the photographer still lost.

and just because it is for sale - doesn't mean they got permission. or they did already. better to be safe. ---Mike Savad
